TERMS AND CONDITIONS

  1. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT

1.1 The contract between MAK-IS s.r.o (hereinafter referred to as " MAK-IS") and the Customer (i.e., the entity, natural person, who makes the purchase on the Site, not related to its commercial, entrepreneurial or professional activity) shall be concluded with the acceptance of the order by MAK-IS. In the event of non-acceptance of the order, MAK-IS will immediately inform the Customer of this decision.

1.2 By placing an order in accordance with the order form on the Web Site (hereinafter referred to as the "Order"), the Customer declares that he/she has read all the information provided to him/her during the purchase process and fully accepts these general terms and conditions (hereinafter referred to as the "Terms and Conditions").

  1. PURCHASE TERMS AND CONDITIONS

2.1 The products offered for sale by MAK-IS are only those presented on the Diumbier.com website at the time the order is sent, as described in the corresponding information sheets.

2.2 It is understood, in all cases, that the images that accompany the description sheet of a product are presented for information purposes only and may not be perfectly representative of its characteristics, but may differ in colour or size (in particular because of the browser and screen used to access the Site and display the images).

2.3 In order to place an order, the Customer must fill in the form on the Site in full and send it after carefully reading the Terms and Conditions, as well as the characteristics of the product and/or the products he intends to purchase. The Customer must also ask MAK-IS, if he or she so desires, to issue a tax invoice for the purchase and MAK-IS will deliver a tax invoice in electronic form to customer’s e-mail address that was registered by customer within subscription process on website www.diumbier.com

 

2.4 MAK-IS will confirm receipt of the Order by means of an e-mail reply sent by the Customer. This confirmation message will contain a summary of the terms and conditions of purchase, as provided for in the applicable regulations, as well as the data that the Customer has inserted in the Order, so that the Customer can check them and, if necessary, communicate without delay the necessary corrections for any incorrect data.

 

  1. PRICE AND TERMS OF PAYMENT

3.1 The prices indicated on the site must be considered inclusive of tax. Any shipping costs or payment charges are, in all cases, communicated in advance to the Customer through the site or these Terms and Conditions.

3.2 The following methods of payment are provided for:

(i) PayPal

For the payment, the customer can use the Paypal circuit according to the specific modalities of the latter.

(ii) Credit Card

When the merchandise is purchased using the Credit Card payment method, the transaction may be executed through the Paypal secure server or another secure server chosen by MAK-IS.

MAK-IS will not under any circumstances and at any stage of the payment process be in a position to know the Customer's Credit Card details, which are transmitted via a secure connection directly to the website of the bank handling the transaction. No computer archive of MAK-IS will store this data and, consequently, MAK-IS shall not be held liable for any fraudulent and improper use of credit cards by third parties at the time of payment.

(iii) Transfer (only for European Union countries)

In case of payment of a purchase by bank transfer, the bank data will be visualized for the payment. The shipment of the goods will only take place after the payment has actually been made to the bank. 

 

  1. DELIVERY OF PRODUCTS AND RELATED COSTS

4.1 The Products purchased will be processed the next working day and delivered to the address indicated by the Customer on the Order within 3-4 working days of acceptance of the Order by MAK-IS, at the cost specifically indicated on the Site before the Order is sent. MAK-IS reserves the right to accept or refuse deliveries. In any case, for deliveries to be made outside European Union, shipping costs and delivery times may vary.

 

4.2 For deliveries requested to countries outside the European Union, any customs duties will be charged to the recipient. The Customer is therefore invited to contact the customs authorities of his own country beforehand to check the costs and possible import limits.

4.3 The delivery times indicated by MAK-IS are to be considered as purely indicative and a delay, as well as any delivery made in several split shipments, shall not entitle the Customer to refuse delivery or to claim compensation or damages.

4.4 At the time of delivery of the products, the Customer is obliged to insure :

  • that the number of packages delivered corresponds to what is indicated on the transport document.
  • that the packaging is integral, that it is neither damaged, wet or altered in any way, in particular with regard to the sealing materials (adhesive tape or metal straps).

Any damage to the packaging and/or the product or the non-correspondence of the number of packages or indications must be immediately noted by indicating them specifically on the delivery document of the product to be returned to the carrier.

Any problems relating to the material integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

  1. RIGHT OF WITHDRAWAL

5.1 In accordance with § 7 of Legislative Decree 102/2014,the Customer may withdraw from the Conditions and, consequently, the purchase contract for any reason, without the need to give any justification and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 In order to exercise the right of withdrawal referred to in Article 5.1 above, the Customer must send MAK-IS a communication to this effect, within the period indicated, to the following e-mail address: office@diumbier.com, or use the form included for this purpose on the Site, or submit a statement explicitly stating his or her decision to cancel the contract. In the event that the withdrawal is made using the form on the Site, the consumer will receive a confirmation of receipt of the withdrawal.

5.3 In the event of withdrawal, the Customer must return the products to MAK-IS at his or her own expense within 14 (fourteen) days following the withdrawal itself, to the following address:

The goods must be returned in perfect condition, with all their components and in their original packaging (envelopes and wrapping), stored and possibly used for the time strictly necessary to establish and check their nature, characteristics and size, according to the normal diligence, without any signs of wear or dirt, in compliance with the conditions mentioned below:

The goods must be returned in perfect condition,

  • the right of withdrawal may apply to the entire product purchased; indeed, it is not possible to exercise the right of withdrawal only on part of the product purchased (eg accessories, complements, etc ...) ;
  • in order for withdrawal to be possible, the product must be integrated and returned in its original packaging with all its parts (including the packaging and any documentation and accessory supplies: labels, tags, seals, etc...) ;
  • the shipping costs (and possible customs duties, if any) for the return of the good will be the exclusive responsibility of the Customer.
  • The shipment, until the certificate of receipt at the address indicated by MAK-IS, is made under the complete responsibility of the Customer;
  • In the event of damage to the goods during transport, MAK-IS will notify the Customer, allowing him to immediately forward his claim to the carrier of his choice and obtain the corresponding refund; the product will then be made available to the Customer and the request for withdrawal will be cancelled at the same time;
  • MAK-IS will not be liable in any way for damage, theft or loss occurring during or in connection with the return shipment.

5.4 MAK-IS, without prejudice to the provisions of article 5.5 below, will reimburse the Customer the full amount already paid, excluding any additional shipping costs, within 14 (fourteen) days from the withdrawal, through a procedure for refunding the amount debited, using the same payment method that the Customer used for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any costs due as a consequence of this refund. MAK-IS may suspend the refund until receipt of the returned product, i.e., until the Customer demonstrates that the product has been shipped correctly, if this has been done previously.

5.5 The Customer will, in any event, be liable for any reduction in the value of the product due to handling of the product other than that necessary to establish the nature, characteristics and operation of the product in question.

MAK-IS may therefore withhold from the amount to be refunded to the Customer the amount resulting from the said reduction in the value of the product.

 

  1. WARRANTIES

6.1 All products sold by MAK-IS are covered by a 24 (twenty-four) month warranty for defects in conformity. In order to receive warranty assistance, the Customer must present the invoice or receipt of payment. During this 24 (twenty-four) month period, the Customer may claim the warranty by reporting the lack of conformity within - and not later than - 2 (two) months from the discovery of the defect itself.

6.2 The guarantee for defects in conformity will be applied on condition that the product in question has been used correctly, in compliance with its intended use and with what is provided for in the instructions for use and washing present in and/or with the product.

6.3 In the event that, for any reason whatsoever, MAK-IS is unable to return a product under warranty (repaired or replaced) to the Customer, or that the repair or replacement would, also due to the value of the product, be excessively expensive, MAK-IS may make a reasonable reduction in the price paid or return the full amount paid, with the termination of the contract.

9.1 The personal data collected upon receipt of the Order will be processed as described in the information note on the processing of personal data Privacy and Cookie Policy.

  1. APPLICABLE LAW

10.1 The sales contract relating to these Conditions and its execution are regulated by Slovak Law, with the non-application of the conflict norms and the United Nations Convention for the International Sale of Goods. For the resolution of the corresponding controversies, the competent Court will be that of MAK-IS residence.
